DECLARATION OF EXPRESS CONSENT REGARDING THE PROCESSING OF PERSONAL DATA

1. LEGAL FRAMEWORK AND NATURE OF THE DECLARATION

This Express Consent Statement contains your freely given consent, limited to specific purposes, after reading and understanding the Information Text prepared by the data controller MimYap Yapı Endüstri İnşaat Taahhüt Makine Çelik San. ve Tic. A.Ş. (the “Company”) in accordance with the Law.

1.2.

The Company processes your personal data when you contact it via:

  • the website operating under the domain name https://mimyap.com.tr/ (including contact and career forms),
  • email, telephone, face-to-face communication, and similar other channels.

  • Within the scope of the Company’s activities in the fields of steel construction, industrial facilities, turnkey facilities, and engineering solutions,
  • filling out the contact and career forms on the website, contacting the Company for the purpose of an offer/business cooperation/job application

it is only valid for additional processing activities of a marketing, promotional, and profiling nature.

Data processing activities necessary for the provision of basic services (e.g., responding to your communication request, making an offer, evaluating your job application, fulfilling legal obligations; other processing conditions within the scope of Law Art. 5/2 and Art. 6) are not subject to your explicit consent. Your failure to give your explicit consent or your withdrawal of your consent does not prevent these mandatory activities.

This statement has been prepared separately from the fulfillment of the information obligation; it is essential that you first read the Information Text and then evaluate this text and check the boxes below of your own free will.

2. PERSONAL DATA SUBJECT TO EXPRESS CONSENT AND PROCESSING PURPOSES

The data processing operations listed below are additional marketing and profiling activities that are not mandatory for the basic services offered to you by the Company (receiving your communication request, making offers, evaluating your job application, etc.). Therefore, they are based on your explicit consent under Article 5/1 of the Law.

2.1. Marketing, Promotion, and Commercial Communication Activities

Your personal data processed within this scope:

  • Your identity data: Your name, surname, title, information about the institution you work for (to the extent you specify in the contact/career form),
  • Your contact data: Your email address, phone number, postal address (if you share it),
  • Website transaction data: Basic log and cookie records related to your use of the website (to the extent necessary to manage your commercial communication preferences).

Purpose:

  • To send you promotions, information, and announcements related to the Company’s steel construction, industrial facilities, bridges, airports, power plants, and similar projects,
  • Providing information about fairs, conferences, seminars, launches, and similar events organized by or participated in by the Company,
  • Providing information about campaigns, opportunities, reference projects, technical innovations, and corporate news related to the Company’s products and services,
  • Sending commercial electronic messages via email, SMS, phone calls, and other electronic communication channels.

Legal Basis:
The processing of your personal data for these marketing and promotional activities and the sending of commercial electronic messages to you is based on your explicit consent under Article 5/1 of the Law.

2.2. Profiling and Marketing Analytics

Your personal data processed in this context:

  • Your identity and contact data (name, surname, email, phone, institution/company information),
  • Information you choose to provide in your message content, such as project type, sector, capacity, location, etc.,
  • Information about your past communication and quotation processes with the company (meeting dates, project type, quotation status, etc.),
  • Limited usage data obtained through the website and digital channels (pages you visited, information you requested, your use of the contact form, etc.).

Purpose:

  • Segmentation of customers/prospective customers, business partners, and suppliers,
  • Identification of individuals and organizations interested in specific project types (e.g., industrial facilities, airports, data centers, bridges, power plants, etc.),
  • Determining more appropriate content and offers based on this segmentation and providing you with personalized information,
  • Developing corporate marketing strategies, improving website content, and optimizing campaign and communication frequency.

Legal Basis:
Profiling and analysis activities of this nature are based on your explicit consent under Article 5/1 of the Law. If you do not give your explicit consent, the Company may provide you with general information; however, it will not perform personalized marketing/profiling based on your past transactions and preferences.

2.3. Additional Data Processing/Sharing in Career and Job Applications

When applying for a job via the Career form on the website and other channels, the following personal data may be processed:

  • Identity data: First name, last name, date of birth (if included in your CV),
  • Contact data: Email, phone number, address information,
  • Professional experience and education information: Work history, references, education status, certificates included in your CV,
  • Visual and audio data: Photo, video link, etc., if included in your CV or attachments,
  • Special category personal data: Data you voluntarily share during the job application process (such as union membership, health information, disability status, etc.).

Purpose (Subject to Explicit Consent):

  • To store your CV in the CV pool for future use in other suitable positions within the Company, not limited to the position for which your application is being evaluated,
  • Where appropriate, to refer you to suitable positions at group companies, overseas branches, or business partners and to share your CV for this purpose,
  • To inform you about career opportunities, new positions, and similar HR announcements.

Legal Basis:
The evaluation of your job application solely for the position you applied for may be carried out without your explicit consent based on one of the provisions of Article 5/2 of the Law (e.g., establishment/performance of a contract, legitimate interest).
However, the longer storage of your CV, its use for other positions, or its sharing with group companies/business partners is subject to your explicit consent under Article 5/1 and Article 6/2 of the Law.

If you do not give your explicit consent or withdraw your consent, your application will continue to be evaluated only for the position you applied for and within the legal retention periods; it will not be negatively affected.

3. EXPLANATION REGARDING DATA PROCESSING NOT SUBJECT TO EXPLICIT CONSENT

3.1.

The Company;

  • Responds to communication and offer requests you submit via the website,
  • Conducts the contract process, prepares and implements project proposals within the scope of the commercial relationship established with you,
  • Evaluate your job applications for the relevant position,
  • Fulfill its legal obligations arising from legislation, primarily tax, commercial, labor, and social security law,
  • Maintain logs and records related to information security and system security,

The Company may process your personal data necessary for these purposes based on the processing conditions other than explicit consent specified in Articles 5 and 6 of the Law (as provided for in legislation, establishment and performance of the contract, fulfillment of legal obligations, legitimate interests, etc.).

3.2.

You do not need to give your explicit consent for these activities. Not giving your explicit consent or withdrawing your consent does not prevent the Company from fulfilling its legal obligations or conducting its contractual/business relationship with you.

4. FREEDOM OF EXPLICIT CONSENT, FORM OF CONSENT, AND WITHDRAWAL OF CONSENT

Your explicit consent statement: relates to specific matters (such as the above-mentioned activities of marketing/promotion, profiling, and storing and sharing career data in the CV pool), is based on information (you acknowledge that you have read the Information Text provided by the Company and have been informed about data processing activities) and is based on free will (your use of basic services, the evaluation of your job application, or our commercial relationship is not contingent upon your giving this consent).

4.2.

You have the right to withhold or partially/fully withdraw your explicit consent. In such a case: The Company will not send you commercial electronic communications for marketing/promotional purposes, will not conduct profiling or personalized marketing activities, and your CV will not be used for positions other than the one you applied for or for group companies/business partners; it will only be evaluated for the relevant position within the legal retention periods.

4.3.

You may withdraw your explicit consent at any time, without providing any reason, and with future effect. To do so:

  • Send an email to info@mimmuh.com.tr,
  • Send an email to ik@mimmuh.com.tr (for consents related to career processes),
  • Use the “communication preference” or similar account settings provided on the website (once implemented),
  • Through other application channels specified in the Information Text

You can submit your request. Your withdrawal request will be processed as soon as possible in accordance with the legally prescribed timeframes and technical capabilities.

5. YOUR RIGHTS UNDER THE LAW

5.1.

In accordance with Article 11 of the Law, by applying to the Company;

  • To learn whether your personal data has been processed,
  • If it has been processed, to request information about it,
  • To learn the purpose of processing and whether it is being used appropriately,
  • Know the third parties to whom your data has been transferred within or outside the country,
  • Request correction if it has been processed incompletely or incorrectly,
  • Request deletion or destruction within the framework of Article 7 of the Law,
  • Request notification of these actions to third parties to whom your data has been transferred,
  • Object to a result that is detrimental to you arising from the analysis of your processed data exclusively through automated systems,
  • Request compensation for damages suffered due to the unlawful processing of your data.

You have these rights. You may exercise these rights in accordance with the application procedures specified in the Company’s Information Text.

6. SCOPE, DURATION, AND LIMITS OF EXPRESS CONSENT

6.1.

This Express Consent Statement is limited solely to the activities listed in Section 2, namely marketing, promotion, profiling, and the storage/transfer of career data in the CV pool. It does not constitute a general and unlimited consent.

6.2.

Your express consent remains valid unless you withdraw it. If you withdraw your explicit consent, marketing, promotion, profiling, and CV pool activities will cease from the date of withdrawal; however, your data may continue to be retained for specific periods in accordance with mandatory retention obligations under the legislation (commercial records, legal limitation periods for job application documents, etc.).
